Massey Energy Company Securities Litigation
June 28, 2010Zwerling Schachter represents the Wayne County Employees’ Retirement System in securities class actions filed against Massey Energy Company (“Massey” or “the Company”), one of the largest coal mining companies in West Virginia and Central Appalachia, and certain of the Company’s officers and directors. The actions, pending in the United States District Court for the Southern District of West Virginia, assert claims on behalf of Massey investors under Sections 10(b) and 20(a) of the Securities Exchange Act of 1934 and Rule 10b-5 promulgated there under, and allege that Massey misrepresented to the public its safety record and its commitment to the safety of its operations. After the April 5, 2010 explosion at Massey’s Upper Big Branch mine in West Virginia, the deadliest mining accident in the United States in nearly 40 years, the public learned of scores of undisclosed and uncorrected safety violations at Massey’s mines and of the Company’s disregard for safety in favor of generating profits.
